Liquor retail business without a license to retail alcohol?
Alcohol business is an activity that is strictly regulated and restricted by the state. Establishments that retail alcohol without a license will be fined in accordance with the law.
According to the provisions of Article 25 of Decree 98/2020/ND-CP on sanctioning of violations in commercial activities, production and trading of counterfeit and banned goods and protection of consumers’ interests, it stipulates:
“A fine of between VND 10,000,000 and 15,000,000 shall be imposed for one of the following violations:
a) Trading in goods and services in conditional business lines without a business license as prescribed;
b) Trading in goods and services in conditional business lines when the granted business license has expired;
c) Trading in goods and services in conditional business lines but failing to satisfy business investment conditions as prescribed in the course of business activities;
d) Using another trader’s business license to do business.”
Conditions for issuance of a liquor retail license
According to Article 13 of Decree 105/2017/ND-CP as amended and supplemented by Decree 17/2020/ND-CP, in order to be granted a liquor retail license, a trader needs to meet the following conditions:
– Being an enterprise, cooperative, union of cooperatives or business household established in accordance with law.
– Having the lawful right to use a fixed business location with a clear address.
– Having a written introduction or a contract in principle of a wine producer, alcohol distributor or alcohol wholesaler.
When meeting the above conditions, traders can apply for a liquor retail license.
Dossier of application for a liquor retail license
To apply for a license to retail alcohol, alcohol retail traders must submit an application to the District Economic Office. In particular, a dossier set includes the following important documents:
- Document proving ownership (or lease agreement) of a liquor retail location
- Contract + Liquor production/distribution/wholesale license of supplier
- Announcement slip
- Business License
In addition, when completing the application, traders also need to fill in the application forms as prescribed. So, what should be paid attention to when applying for a liquor retail license?
Application for a Liquor Retail License
To carry out the procedure for applying for a liquor retail license, traders should note the following steps:
Step 1: After preparing all the required documents, the trader submits the application in person or by post or online to the licensing authority;
Step 2: Within 10 working days from the date of receipt of complete and valid dossiers, competent state agencies shall consider, appraise and grant licenses to traders. In case of refusal, a written reply must be given clearly stating the reason.
Step 3: In case there are not enough valid dossiers, within 03 working days from the date of receiving the dossiers, the licensing agency must make a written request for supplementation.
Step 4: Return the result of the Retail Liquor License to the trader.
